Docu Prep Privacy Policy

Notice to California Consumers: The following Privacy Policy is generally applicable; however, it incorporates the information and requirements of the California Consumer Privacy Act (“CCPA”).

Docu Prep, Inc, a Utah corporation, headquartered at 5353 S. 960 E, Suite 120, Salt Lake City, Utah 84117, is defined as a Service Provider under the CCPA—meaning Docu Prep only processes information on behalf of its business clients and Docu Prep’s business clients only disclose a consumer’s Personal Information to Docu Prep for a business purpose under a contractual agreement that prohibits Docu Prep from retaining, using, or disclosing the Personal Information for any purpose other than the services specified by contract, or as otherwise permitted by the CCPA.

1. Scope of This Policy

This policy applies to all Docu Prep clients, as well as to any other users of any of Docu Prep’s services, applications, softwares, websites, or other innovative technologies or platforms (collectively, “Docu Prep Services”). Please note that use of Docu Prep Services is also subject to our Terms of Use.

This Privacy Policy is meant to help users of Docu Prep Services understand how Docu Prep safeguards the consumer and other data it receives.

2. The Information We Collect

Docu Prep may receive consumer Personal Information under its business contracts with a client, or Docu Prep may collect information about a consumer through Services on behalf of one of its clients. Information regarding visitors to Docu Prep’s website may also be collected in accordance with our Terms of Use. This information may identify, relate to, describe, refer to, or be capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”).

Personal Information that may be collected by, or shared with, Docu Prep by our business clients includes, but is not limited to the following:

Name identifiers, e.g., legal name, aliases, signature; demographic and biometric information, e.g., race, ethnicity, sex, photo ID; unique personal and government identifiers, e.g., driver license, state ID, social security number, passport number, citizenship, alien status; complete profile information, e.g., education, employment, employment history, marital status, dependents, current or previous military service; contact information, e.g., current postal address, home purchase postal address, home purchase legal location description, email address, telephone number; online identifiers, e.g., IP address, website cookies, viewed advertisements, geolocation; banking information, e.g., account names, bank account information, mortgage loan number, insurance policy numbers and coverages, credit card or debit card number, credit score, credit history, gross monthly income, military entitlements, assets, liabilities, real estate owned, tax returns, other loans made, other products or services purchased, and any other necessary financial information; loan profile, e.g., loan amount requested, loan type, down-payment assistance, money gifts, property seller, occupancy intentions, business intentions, LTV, title description, trust information; and any other personal, probabilistic, or financial information that could be used to personally identify the consumer.

The above Personal Information is usually data a consumer has provided to a business (a client of Docu Prep) during the application process for a loan or other financial service; however, some information may have been collected via direct interaction with the business, whether in person or electronically, and other information may have been obtained from third-parties at the request of the consumer to whom the Personal Information belongs.

Personal Information does not include:

  • Publicly available information from government records.
  • De-identified or aggregated consumer information.
  • Information excluded from the CCPA’s scope, like:
    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
    • Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

The Personal Information listed above comes to Docu Prep as a Service Provider from the following sources:

  • Directly from our clients or their agents. For example, from documents that our clients provide to us related to the services for which they engage us.
  • Indirectly from our clients or their agents. For example, through information we collect from our clients in the course of providing services to them.
  • Directly and indirectly from activity on our websites. For example, from submissions through our website portal or website usage details collected automatically. Please note that “Cookies” are collected by this website.
  • From third-parties that interact with us in connection with Services. For example, through one of our services, a client may request a consumer’s credit reports from an integrated credit bureau reporting service.

Docu Prep also collects information from its business clients and non-consumer users of Docu Prep Services that is specific to the business or user and not related to a consumer (“Business Information”).

3. How We Use Information

Docu Prep uses Personal Information to process the contractual requests of Docu Prep’s clients. Some of these purposes include:

  • To fulfill or meet the reason for which the information is provided.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between us and our clients, including for billing and collections.
  • For testing, research, analysis and product development.
  • As necessary or appropriate to protect the rights, property or safety of us, our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to consumers when collecting Personal Information or as otherwise set forth in the CCPA.
  • To provide customer support.
  • To respond to auditors, legal proceedings, or other supervising entities.

Docu Prep uses current and potential client’s Business Information to provide clients with the information or content requested, and, in some cases, to contact them about our programs, products, features or services.

Docu Prep uses non-identifying information collected on its website in the aggregate to better understand user interaction with the website and to enhance user enjoyment and experience.

4. How We Share Information

Docu Prep is only operating in the capacity of Service Provider, and therefore does not share Personal Information for any reason.

In the preceding 12 months, Docu Prep has not disclosed a Personal or Business Information with any third-party.

In the preceding 12 months, Docu Prep has not sold Personal or Business Information, and does not engage in the sale of Personal or Business Information.

5. How We Store and Protect Information

Docu Prep only holds Personal Information for as long as necessary to (1) complete a transaction, (2) perform billing and accounting procedures, (3) according to any federal or state legal or regulatory compliance requirements, and (4) according to client-related retention requirements/contractual agreements.

To help protect consumer and client data, Docu Prep takes reasonable and appropriate measures designed to protect Personal and Business Information. When the transmission of Personal or Business Information is required over the internet, we protect it through the use of encryption. However, please note that no data transmission over the internet can be guaranteed to be completely secure.

6. Rights and Choices Regarding Information

As a Service Provider, Docu Prep does not engage in the collection of a consumer’s Personal Information for its own business purpose; rather, Docu Prep only collects or processes Personal Information on behalf of its business clients. For a consumer to know more about any Personal Information that may have been shared with Docu Prep, that consumer should contact the business client of Docu Prep to whom the consumer has provided Personal Information.

All Users

Profile Information. You can review and edit certain account information you or your administrator have chosen to add to your profile by logging in to your account or contacting your administrator.

Cookie Tracking. You can modify your cookie settings on your browser, but if you delete or choose not to accept our cookies, you may be missing out on certain features.

California Consumers

Right to Know. California consumers have the right to know and see what data has been collected about them over the past 12 months, including:

  • The categories of Personal Information we have collected about you;
  • The categories of sources from which the Personal Information is collected;
  • The business or commercial purpose for collecting your Personal Information;
  • The categories of third parties with whom we have shared your Personal Information; and
  • The specific pieces of Personal Information we have collected about you.

Right to Delete. California consumers have the right to request that Personal Information collected from them be deleted (by both the business collecting the information and the Service Providers with whom it has been shared). There are a number of exceptions, however, that include, but are not limited to, when the information is necessary to do any of the following:

  • Complete the consumer’s transaction;
  • Provide the consumer with a good or service;
  • Perform a contract between the business and the consumer;
  • Protect a consumer’s security and prosecute those responsible for breaching it;
  • Fix the system in the case of a bug;
  • Protect the free speech rights of a consumer or other users;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interests that adheres to all other applicable ethics and privacy laws;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of the information that are compatible with the context in which a consumer provided it.

Other Rights. Consumers can request certain information about a business’s disclosure of Personal Information to third parties for its own direct marketing purposes during the preceding calendar year. This request is free and may be made once a year. A consumer may also have the right not to be discriminated against for exercising any of the rights listed above.

Exercising Consumer California Privacy Rights. To request access to or deletion of Personal Information, or to exercise any other data rights under California law, please contact the business that collected the information that was shared with us. That business will contact us to complete your request.

7. Consent To Transfer

Please note that Docu Prep Services are operated in the United States. If you are located outside of the United States, you are on notice that any information you provide to us will be transferred within the jurisdiction of the United States. By using Docu Prep Services, you consent to this transfer.

8. Children’s Data

Docu Prep Services are not provided to children. If you have a question regarding the data of a consumer younger than 16 years of age, please refer to the privacy policy of the business that collected data shared with Docu Prep. Any requests to delete a consumer’s information must be initiated with the business that collected the data.

California Consumers

Docu Prep does not sell its data, and thus, protects the data of any consumers younger than 16 without the need for them, or their guardians (in the case of consumers younger than 13), to opt-in to the sell of data.

9. Links to Third-Party Websites

Docu Prep Services may contain links to third-party websites. Those websites may have privacy policies that differ from ours. We are not responsible for those websites. We recommend that you review their policies.

10. Changes to This Privacy Policy

We may update this policy from time-to-time as Docu Prep Services or privacy laws evolve. If we update it, we will take reasonable measures to provide notification to clients and users of Docu Prep Services. When you use Docu Prep Services, you are agreeing to the most recent terms of this privacy policy.
